NEW CANAAN, Conn. A third man accused of attacking a 16-year-old boy five months ago returns to Norwalk Superior Court Tuesday to face assault charges.
Mark E. Miller, 20, of 33 Millport Ave., pleaded not guilty on Sept. 13 to charges of first-degree assault, conspiracy to commit first-degree assault, both felonies, and interfering with a 911 call. Miller was arrested Sept. 7 on a warrant and extradited from Jacksonville, N.C.
Police said Miller was one of three men involved in an April 29 assault in the parking lot of the Mobil gas station on South Avenue. Police said the 16-year-old and a friend were walking through the parking lot at about 10:24 p.m. when a group of young men yelled at him in an attempt to start a fight. Moments later, several men ran toward the 16-year-old, grabbed him by the neck and threw him to the ground. Police said the victim was held while others kicked and stomped on his knee, causing serious injury.
Millers arrest came after police interviewed witnesses.
Trevor Harvey, 21, of 37 St. John Place, and Jeremy L. Finnegan, 22, of 186 Lakeview Ave., were arrested in July . Each was charged with first-degree assault and conspiracy to commit first-degree assault. Finnegan was also charged with second-degree making a false statement.
Harvey is scheduled to appear Oct. 11 in Norwalk Court. Information on Finnegans next court appearance was not available on Monday.
