“After a thorough review of all evidence presented, I have concluded that that there is insufficient evidence to prove beyond a reasonable doubt that any specific person committed a crime,” State's Attorney David Cohen said in a release.
The New Canaan Police Department will now start an internal investigation to determine whether any rules or regulations of the department were violated with Lt. Frederick Pickering’s actions that night, the release said. The officer was involved in a physical altercation while off-duty at the New Canaan restaurant, previous reports said.
He has been on administrative leave since the incident was reported.
The group that reported the dispute to police also said that a person with Pickering used racially insensitive language, previous reports said.
The case was brought to the state attorney’s office for review in the first week in May.
