Nowacki said his First Amendment rights were violated with the new restrictions from New Canaan that bar him from having contact with public officials. He plans to file a lawsuit if he and the town cannot come to an agreement.
“I am tired of being abused by these people and the power they think they have,” Nowacki said.
He said he believes the restrictions were put in place in part because of the criminal complaint he filed April 1 against town officials, including Mallozzi and the public school district, claiming that the schools did not report all of its income and expenses in the budget process.
“Why am I scary? Because I am a whistle-blower,” Nowacki said. He also said he plans to run for the Town Council this fall to change the system “from the inside.”
Here is the complete list of restrictions, according to the letter Nowacki received from Mallozzi and the town’s Police Department:
? You shall not go to New Canaan Town Hall Offices, located at 174 South Ave., 237 Elm St., 77 Main St. and 848 Weed St., unless you have a preapproved appointment as per paragraph 2 below.
? All appointments concerning Town Hall matters shall be preapproved and prescheduled by Town Administrator Thomas Stadler. These appointments will be scheduled on an as-needed basis and as scheduling and employee workloads permit. Requests should be communicated in email.
? You shall not communicate (i.e. via email, telephone calls and/or other means of communication) with any Town Hall employees and/or Town Officials subject to restriction# 2 above and #5 below.
? From this date forward all of your email communications shall be automatically forwarded to Town Administrator Thomas Stadler. No other Town Hall employees or town officials will receive your emails directly.
? Any and all communication with New Canaan Town Hall shall be with Town Administrator Thomas Stadler and shall be via email. Mr. Stadler will then decide what responses, if any, are necessary by the town.
? Restriction #1 above does not apply to public meetings. You are allowed to attend public meetings to which members of the general public may attend.
“We get very, very frightening emails,” Mallozzi said previously of the contact with Nowacki. “They’ve become overwhelming.”
Mallozzi described Nowacki's requests for information and and criticisms as “clogging the system” and added that the way Nowacki “lays into” employees and his previous legal history also played a role in the ban.
